GLimpse of Trafficking bill,2018 and SC/SC Bill,2018
- Trafficking of Persons (Prevention, Protection and Rehabilitation) Bill, 2018 = With declaring trafficking as criminal offence it has made provisions to systematically combat the organised nature of trafficking + 1) approaches of prevention, rescue and rehabilitation to create a robust policy framework against trafficking. It places at its core the rights and welfare of victims of human trafficking + 2) Bill provides protection to witnesses. It also seeks to maintain the confidentiality of victims by recording their statements through video conferencing and by in camera proceedings. It states that there will be time-bound trials and repatriation of victims. + 3) A rehabilitation fund has been introduced for the first time.
- SC/ST (Prevention of Atrocities) Amendment Bill = seeks to override SC judgement which stated that the arrest of the accused persons should be approved by the Senior Superintendent of Police concerned(fundamental right of an innocent person to be protected from arbitrary arrest should be protected) + The amendments provide that no preliminary enquiry will be required for registration of an FIR against any person under the Act; and the investigating officer will not require approval for arrests, if necessary. The provision of anticipatory bail as allowed by the Supreme Court has also been done away with.
